BYLAW NO. 469

A BYLAW Establishing an Alternative Municipal Tax Collection Scheme for 2020

WHEREAS the Council for the Village of Sayward, in open meeting assembled, enacts as follows:

Title

  1. This Bylaw may be cited for all purposes as the “Alternative Municipal Tax Collection Scheme Bylaw, 2020”
  2. Alternative Tax Collection Scheme

(1) The Alternative Tax Collection Scheme applies only to property taxes levied on parcels of land and associated improvements that are classified as Class 1 Residential for the purposes of taxation.

(2) Subject to any owner election under this bylaw, the property taxes payable to the Village of Sayward are due and shall be payable on or before July 2, 2020.

(3) An owner may elect to pay the taxes owed under the Alternative Municipal Tax Collection Scheme by providing written notice of that election to the Collector no later than June 30, 2020.

(4) An owner may elect to pay the rates and taxes owed under this Bylaw under the General Tax Collection Scheme under s. 234 of the Community Charter on or before July 2, 2020 by giving written notice of that election to the Collector no later than June 30, 2020.

(5) If an owner makes no election under subsections (3) or (4) the Alternative Municipal Tax Collection Scheme automatically applies.

(6) An Owner must give any notice under this section to the Collector at his or her office at 652 H’Kusam Way, Sayward, BC V0P 1R0, or by email at village@saywardvalley.ca.

3. Penalties

(1) If the Alternative Municipal Tax Collection Scheme applies to a parcel of land and its improvements, the Collector must add to the unpaid balance of the current year’s taxes, in respect of each parcel of land and the improvements as shown on the tax roll, a penalty of ten (10%) per cent to be applied in relation to payments made more than 90 days after the tax due date of July 2, 2020. For clarity, the penalty on outstanding balances will be applied to the account on October 1, 2020 for amounts unpaid as of September 30, 2020.

(2) If the General Tax Collection Scheme applies to a parcel of land and its improvements, the Collector must apply the penalties and interest set out in any regulation under section 234 of the Community Charter.

4. Automatic Repeal

(1) On December 31, 2020. This Bylaw is automatically repealed.
